Family Investment Fund in GIFT City: Single Family Office Guide

How a Family Investment Fund in GIFT City works: who qualifies, the minimum corpus, what it can invest in, LRS and overseas routes, tax, cost and steps.

A Family Investment Fund, or FIF, is IFSCA's route for a single family to run its own investment pool from GIFT City. It is self-managed: the fund and the manager are the same entity, so no separate fund manager is registered, and the money comes only from one family. For a business family that already invests abroad through scattered LRS remittances and overseas accounts, it offers one regulated, dollar-based home inside India.

It is not a shortcut. The fund must reach a minimum size within a set time, keep real people and an office in GIFT City and respect limits on investing back into India. This guide covers who qualifies, what the fund may do, how money gets in, tax, cost and the steps.

What an FIF is and who counts as family

An FIF pools the money of a single family and invests it under IFSCA oversight. It can be set up as a company, an LLP or a trust in GIFT City. Because it is self-managed, the FIF itself registers with IFSCA and carries the manager's obligations.

Single family is defined to include the family's individuals and the entities they control; the reported test covers entities at least 90 percent owned by the family, along with family trusts. Outside money, even from close friends or business partners, is not allowed. Taking outside money later needs a different licence.

Corpus, people and office

The core conditions, set out below, are few but firm.

The three-year window helps a family that wants to move money in stages, across several LRS years. Write down the path to the minimum before you apply, because missing it is a regulatory problem, not a paperwork one.

  • Minimum corpus: USD 10 million, to be reached within three years of registration.
  • People: at least one investment professional based in GIFT City, plus the compliance duties the regulations assign.
  • Office: a physical office in GIFT City, not an address used only for paperwork.
  • Fees: IFSCA application and registration fees in US dollars; one set of figures seen is USD 2,500 on application and USD 15,000 on registration, so check the current fee circular.

What an FIF can invest in

The scope is broad. An FIF can invest in listed and unlisted equity and debt, overseas funds, real estate and assets such as art and bullion, and it can borrow within limits. That breadth is the main reason a family chooses an FIF over scattered personal holdings abroad.

The key restriction is India. Money that left India under LRS cannot be routed back into Indian assets through the FIF, and any Indian investment the fund does make is treated as foreign investment with its own conditions. Treat the FIF as the family's global portfolio, not a loop back home.

How the family's money gets in

For FEMA, GIFT City is outside India, so every rupee that goes into an FIF is an outward remittance or overseas investment. Resident individuals use the Liberalised Remittance Scheme, up to USD 250,000 per person per financial year, and tax is collected at source above Rs 10 lakh a year, at 20 percent for most investment remittances. That TCS is adjusted against the person's own tax, so it is a cash-flow cost rather than an extra tax.

Four adult members can together remit about USD 1 million a year under LRS, so reaching USD 10 million through LRS alone takes time. Indian companies and LLPs in the group can invest under the overseas investment rules, as ODI or OPI depending on the structure, within limits linked to their net worth and without the LRS collection.

Each route has its own reporting: the bank's LRS records for individuals, and ODI or OPI filings and annual returns for entities. Build these into the calendar from day one.

Tax position

An FIF set up in GIFT City is an Indian tax resident, so the question of where it is managed does not arise. Its tax outcome depends on its legal form and on whether its income qualifies for any IFSC relief. The section 80LA deduction is aimed at business income of IFSC units, so whether an FIF's investment income benefits depends on its form and income type. Get this confirmed in writing for your structure.

On the family side, LRS remittances are not income, but TCS applies above the threshold. Where a family trust or company sits above the FIF, the trust tax and clubbing rules at that level still apply. Section numbers follow the Income-tax Act, 1961; the Income-tax Act, 2025, in force from 1 April 2026, renumbers them.

Where an FIF fits in the family structure

Many families place an Indian family trust or a family holding company or LLP above the FIF, so that succession and control are handled in India while the global portfolio sits in GIFT City. The trust deed, the FIF documents and the family's wills should point in the same direction.

An FIF does not replace a family office for the Indian portfolio. Indian listed shares, the operating business and Indian real estate usually stay in the domestic structure, with consolidated reporting across both.

Set-up steps

A typical sequence is set out below.

Counsel drafts the constitution documents and the family files with IFSCA. The CA work is the funding plan, the FEMA filings, the tax position and consolidated reporting.

  • Map the family: who invests, from which person or entity, and how much each year.
  • Choose the FIF's form (company, LLP or trust) and whether a family trust or holding entity sits above it.
  • Secure office space in GIFT City and incorporate or settle the FIF entity.
  • Apply to IFSCA for registration and IFSC unit approval, with the investment professional identified.
  • Open the foreign currency account and start remittances with the correct purpose codes.
  • Adopt an investment policy, a custody and reporting set-up and a compliance calendar.

Frequently asked questions

What is the minimum size of a family investment fund in GIFT City?

The reported requirement is a corpus of USD 10 million, to be reached within three years of registration. Plan the funding path before you apply.

Can a family investment fund take money from friends or partners?

No. It is for a single family and the entities it controls. Outside money needs a different IFSCA licence, usually through a Fund Management Entity.

Can an FIF invest in India?

Money that left India under LRS cannot be routed back into Indian assets through the FIF, and any Indian investment it makes is treated as foreign investment with its own conditions.

How long does it take to set up an FIF?

Practitioners quote a few months, driven mostly by office space, documents and the IFSCA review. The funding plan to reach the minimum corpus should be ready before you apply.

Figures in this guide (fees, rates, limits and dates) reflect the rules as of September 2026. They change often, so confirm the current position before you act.
